Overcoming the odds While many of the cases that we’re instructed on are difficult, recovering money from businesses which are experiencing significant financial difficulties is about as challenging as it gets. So when initial background checks on our client’s debtor showed County Court Judgments and a winding-up petition from HM Revenue & Customs, we knew that successfully recovering more than £4,000 from them was going to require all of our experience. Our client’s debtor was a lettings agency, who were proving difficult to get hold of, prompting our debt recovery team to be instructed. After our attempts at contact, which included visits to their premises, were unsuccessful and the background checks revealed the extent of the situation, our client was happy to go down the legal avenue and issue a letter before action. This proved to be enough to encourage the debtor to end their silence and propose a payment plan of £500 a month until the full balance, plus interest, was paid off. After the first six instalments were received successfully, no more followed and our subsequent attempts to re-establish contact were ignored. Further investigation showed that the debtor had ceased trading. After explaining to our client the options we were left with to recover the remaining balance, they decided against taking any further action and were happy with the fact £3,000 had successfully been recovered.
